The Insurance (Disregard Certain Medical History and Miscellaneous Provisions) Act 2026 comes into effect on the 15 October. Under this legislation, eligible applicants may be able to access mortgage protection cover without their previous cancer diagnosis being taken into account, provided:
The application is for new mortgage protection cover on their principal private residence.
The total amount of mortgage protection cover is €650,000 or less.
Cancer treatment ended more than five years before the application date.
This change has the potential to improve access to protection for many cancer survivors and supports greater inclusivity within the mortgage protection market. Applicants must continue to disclose any previous cancer diagnosis when completing their application.
Eligibility under the legislation will be assessed as part of the underwriting process. Please note that this legislation applies only to qualifying mortgage protection applications and does not extend to other protection products.
